ST. CLAIRSVILLE, Ohio -- One of the three defendants in a St. Clairsville case that has drawn national attention had the charges against him dropped during a court hearing Friday.
Innkeeper Bruce Callarik was facing one count of complicity to receive stolen property in the case in which he and two police chiefs allegedly conspired to break into the home of a surrogate mother who was carrying twins for Hollywood couple Sarah Jessica Parker and Matthew Broderick.
Callarik could have been sentenced to 18 months in prison if convicted.
"Justice would be best served this way," Special Prosecutor Shawn Hervey said to Common Pleas Judge John Solovan.
The pregnant woman lived in Belmont County at the time, and was a major object of interest for a national tabloid reporter.
But one of Callarik's attorneys wanted to clarify one point: Contrary to erroneous reports, Callarik did not agree to testify against anyone in particular.
"There was some information out that Mr. Callarik was testifying against the other defendants," said Charles Bean, Callarik's defense attorney. "That was never the agreeement. The agreement was that Mr. Callarik would make himself available, stay in the jurisdiction and testify truthfully at the trial of this case."
"Bruce is happy obviously," Bean said. "All the charges have been dismissed against him. And he realizes that as a citizen, he would have to testify anyway. And he's subject to subpoena, and he will testify, if asked by anybody."
The other two defendants, former Martins Ferry Police Chief Barry Carpenter and former Bridgeport Police Chief Chad Dojack are still awaiting their trials.
Dojack is Bruce Callarik's son-in-law.
